Quelle protection des données personnelles en Europe ?

The digital economy is based upon the value of personal data and as such a new data market has appeared. The European Union should today find a fair equilibrium between the emergence of a personal data market created by the Internet giants, whom are mostly American, and the recognition of a fundamental right for citizens of the European Union to have their data protected: freedom versus market (economic issues) and freedom versus security (security issues). The adoption of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (General Data Protection Regulation) and by Directive (EU) 2016/680 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data by competent authorities for the purposes of prevention, investigation, detection or prosecution of criminal offences or execution of criminal penalties, and on the free movement of such data poses new rules in this sense.

 

This article poses the question of what type of Europe will be created: a Europe committed to the digital liberties of its citizens? A Europe sympathetic towards the champions of the digital economy? A Europe preoccupied against the fight versus terrorism? Only the future will tell. Without a doubt, Europe is at a major turning point in its history during a time of strong geopolitical and normative competition.
